Coaching and Leadership in the Workplace Essay

As indicated by Mike Noble in his article, Transform Managers into Coaches: Five Steps for Coaching Success, a compelling director is a mentor and not only a chief. The best chiefs are the individuals who can mentor and team up. In the event that one can mentor their workers successfully, at that point they can make feasible long haul results for themselves and their organization. Instructing is activity of helping other people to perform better, regardless of whether it is through input, exhibits, or educating. It is putting resources into the individuals inside an organization and molding them into better representatives so they can play out their undertakings better, yet additionally better meet all requirements for advancements. Mike Noble’s article separates the five stages important for effectively turning into a training head and the advantages of getting one. By instructing your workers, you become a transformational pioneer who improves just as produces new encounters for representatives, in this manner increasing a more grounded degree of responsibility from them. The initial step to changing a supervisor into a training head is to manufacture an individual case for instructing. The chief needs to need to build up their training aptitudes and see the importance of creating them. When a chief comprehends that they can accomplish better outcomes through instructing as opposed to taking an order and control reaction to the board, they will build up their abilities as a mentor. Administrators are increasingly disposed to take advantage of the lucky break when they understand that numerous fruitful pioneers and officials are mentors in their particular controls. Next, firm desires should be set in regards to instructing. By explaining the desire that instructing is the essential duty of every chief, you are making a training society. On the off chance that a firm or association has a solid corporate culture of training, it makes a positive domain that representatives need to be a piece of and take an interest in inside that firm or association. Training ought to be a piece of each manager’s expected set of responsibilities. For the third step, one should show training abilities and set up them as a regular occurrence. Training doesn't fall into place easily for everybody and center instructing abilities can be educated in an assortment of ways. The way to growing great training aptitudes is having the option to place them to use, in actuality, circumstances whenever coachable open doors happen. In the event that you need an administrator to change into a decent mentor, there is no preferable route over to give them their very own mentor so they can encounter things hands on. The fourth step in the change procedure is to be doled out a mentor. By appointing them a mentor, it empowers a director not exclusively to encounter the advantages of training yet gives a viable model to instructing others. The last advance to building up a training supervisor is to remunerate the best mentors with the best occupations. Those with the most grounded training abilities are possibly the most grounded entertainers and in this manner the best possibility for significant administrator and official jobs in an association. The advantages of turning into a training director are professional success and generally speaking advantages to the association with fortified aptitudes in their representatives. At the present time, I have a legitimate style of administration, yet I emphatically need to build up my training aptitudes and adjust my conduct. My head supervisor is a solid instructing chief who I respect incredibly and she is my mentor from whom I get familiar with every one of my exercises. I have all the propensities for a solid moral pioneer in that I have solid individual character and an energy to make the right decision. I generally attempt to think about the enthusiasm of the partners, be proactive, and model the estimations of my organization. These characteristics make me a decent director, however I would prefer only not to be acceptable, I need to be the best. On the off chance that I am to be the best, I need to build up the most grounded group and I can just do by training them to be better. At the present time, I am only an associate café administrator with McDonalds, however I mean to go up and want just to travel through the positions rapidly. McDonald’s centers its preparation around training and improving execution, so that is the reason I discover this article so applicable to authority styles. You can mentor somebody to settle on choices that are progressively moral and make the best choice. On the off chance that building up an instructing initiative style implies I will manufacture a more grounded group at my café, at that point that is the thing that I need to do. I need to have the option to impart my solid moral culture to other people and the most ideal route for me to do that is to mentor them. I need to cultivate long haul accomplishment among my kin and make a constructive atmosphere where individuals need to work. Starting at this moment, I have experienced four of the five stages in creating myself as a training director. I have recognized my own case for instructing and I comprehend how might this benefit me. I need to go up and that is my inspiring component. My head supervisor at work has set firm desires for me in turning into a training chief. She has define objectives for me and I am chipping away at accomplishing them. At work, I bring the abilities I am creating onto the floor and execute them into circumstances as they happen. I gain new things day by day from my mentor, my senior supervisor Jessica, and I attempt to impart those things to the individuals I am instructing. Now in my profession, I can dare to dream that the things I am learning and bringing onto the floor are powerful and I will before long observe myself receive the benefit of turning into a first right hand chief at work and one day turning into a senior supervisor.

Are You Sabotaging Your Relationships

Are You Sabotaging Your Relationships Why We Self-Sabotage The specific reasons why someone may self-sabotage relationships are context-specific. Every person has had a different past: parenting, childhood, teenage years and first serious relationships all have an effect on how we act right now. One of the main reasons why people sabotage their relationships is fear of intimacy. People are afraid of intimacy when they fear emotional or physical closeness with other people. Everyone wants and needs intimacy, but in people with certain experiences, intimacy may be linked to negative rather than positive experiences, leading to a push-and-pull-type behavior that leads to a relationship breakup or avoidance. Fear of intimacy typically comes from difficult or abusive parental relationships and childhood trauma (physical, sexual, emotional). The deep, embedded belief in people who fear intimacy is: people who I am close to cannot be trusted. Because early trusting relationships with parents or caregivers were broken by abuse, people who fear intimacy believe that people who love them will inevitably hurt them. As children, they could not extricate themselves from these relationships; however, as adults, they have the power to end or leave them, even when they are not inherently abusive. This fear appears in two types: fear of abandonment and fear of engulfment. In the first, people are worried that those they love will leave them when they are most vulnerable; in the second, people are worried that they will lose their identity or ability to make decisions for themselves. These two fears often exist together, leading to the push-and-pull behavior so typical of those with deep fears of intimacy. Signs Of Self-Sabotage In Relationships There are many signs that you might have a tendency to self-sabotage even the best of relationships. Here are some of the most common. You always have an eye on the exit You avoid anything that leads to bigger commitment: meeting parents, moving in together, etc. Youre always wondering: if it goes wrong, how can I extricate myself easily from this relationship? Because commitment reduces your ability to leave a relationship without financial or emotional consequences, you tend to avoid it. You gaslight your partner Gaslighting is a form of emotional abuse whose aim is to deny the other persons reality or experiences. For example, if your partner says: Im really upset that you canceled our date, you respond with something like: Youre not really upset, its your fault I canceled and youre just trying to blame me for it. Gaslighting is a sign that you dont really believe your partners feelings are valid or real (even though they are). You are known as a serial dater Your friends often ask you why you break up with potential partners so often or lament the fact that you never seem to settle down with anyone. You break up with partners on the slightest of issues, only to start dating another person right away and repeat the cycle. You dont want to be seen as a player but you cant seem to find someone who you can commit to. You are paranoid or extremely jealous You always worry that your partner might be seeing someone else behind your back. You demand control over every aspect of their life and require constant contact. When they spend time with other people without you, you fret, text constantly, experience jealousy, and ask for proof that theyre being faithful. They break up with you because they find you controlling. You criticize everything they do You constantly look for perfection in a partner, even though you know perfection is impossible. You find fault with every little thing they do, from the way they cook to the clothes they wear. You are impossible to please, and your partner eventually gives up trying and breaks up with you. You avoid facing problems You spend a lot of time trying to convince yourself that the relationship is perfect, even when its not. When your partner wants to address a problem, you avoid the topic or simply say: I dont think were having an issue; its going to go away. Your partner grows resentful of your inability to face problems together and leaves. You have sex with other people While in some cases having sex with other people is okay when both people agree to non-monogamy, in general, going from affair to affair can be a sign of self-sabotage. Youre doing one of the most hurtful things you can do to a romantic partner in the hopes that theyll find out and leave you. You always tear yourself down You always talk about yourself in self-deprecating ways: Im not as smart as you, Im just an idiot, why are you with me?, Youre just with me because you pity me, etc. This is a sign of low self-esteem, and most people do not enjoy being told that they love someone who is worthless. When, despite their constant reassurance that you are a good person, you keep tearing yourself down, they give up and break up. These are just a few examples of how people with a fear of intimacy might sabotage their relationships. Note that many of them are abusive: things like gaslighting, paranoia and control can damage the other person. People with these patterns have childhood trauma and dont know how else to act. How Do You Behave in Romantic Relationships? Why Its a Problem Even when you recognize signs of self-sabotage in your relationships, you may not initially feel a desire to stop these problematic behaviors. Such patterns allow you to exit relationships when you want toâ€"and thats exactly the problem. You want out in order to avoid the intimacy you fear in the short-term, but such actions can create difficulties that can haunt you in the long-term. Why does it matter that you want to continually end your relationships, even when things are going well? Some of the potential long-term consequences include: A lack of intimate relationships. As time goes on, you may find yourself longing for a close, secure, long-term relationship. Self-sabotaging behaviors make any kind of commitment difficult to find and maintain.  Loneliness. Lack of close relationships can leave people feeling isolated. You might find yourself longing for connections that you feel unable to forge or keep.Lack of children and family. While not everyone has a desire to have children, some people may find themselves wishing that they had a partner with whom to have a family.  Trouble tolerating closeness. Repeatedly ending your relationships before you can build true intimacy can make it even harder to get close to future partners. Even as you grow closer to a person, you may find yourself constantly holding back parts of yourself out of a fear of getting too attached and then getting burned. Ending Self-Sabotage To end self-sabotage, you first need to take a good, hard look at yourself and your behavior patterns. Unless you are willing to be honest with yourself and face all the ways you may have abused or hurt other people because of your fear of intimacy, you are doomed to repeat it. Therapy is the first step many take to end their self-sabotaging patterns. A professional can help you identify your behaviors, dig to the root of your issues, and find new, healthier ways to behave. In general, a few things are important to uncover when ending self-sabotage. What is your attachment style? Attachment theory is a framework that explains patterns of behavior with intimate others. The ideal type of attachment is secure: this is when people feel like they can trust others and remain a distinct individual, even in close relationships. However, childhood experiences can lead to anxious, avoidant, or disordered attachment styles: these are the ones that cause issues in adults trying to develop strong relationships and families. The good news: you can work with a therapist on developing a more secure style by facing your fears and removing false beliefs about relationships. What are your triggers? Fear of intimacy and self-sabotage can remain dormant until a trigger wakes them up. It might be words, actions or even places. Knowing what triggers your fears will help you either avoid them or work on them so they dont trigger you anymore. Do you confuse the past with the present? One of the main problems of self-sabotaging is that we behave in the present as if the current situation was the same as one in the past. It can be childhood or past adult relationships. Learning to say: that was then, this is now can help you make decisions that are based on the present, rather than reacting blindly based on what happened to you in the past. Can you talk about these issues? One of the hallmarks of self-sabotage and fear of intimacy is the inability to talk about your feelings and your problems. You avoid talking about these things because talking means feeling, and you want to avoid feeling these things at all costs. Expressing your emotions, your fears and your needs will not only help you identify the problems but will also help others understand you better. Get The Help You Need Remember that its okay to get help. Seeking therapy, or simply a kind and friendly ear is the first step towards freeing yourself from self-sabotaging behaviors in relationships. Be kind to yourself and accept that everyone needs help once in a while. Tips to Help You Date More Mindfully

The short story can produce many different types of characters. Usually, these characters are faced with situations that give us an insight into their true character. The main character of the story is faced with a fear. He is afraid of an Old Mans Eye that lives with him. The actions that this charecter or man - as he is known in the story - performs in order to stop his fear can lead others to believe that he suffers from some sort of mental illness. He found comfort in knowing that the eye was not watching him, that it could not see the true evil in him. While the eye was closed, so was the idea of killing the old man. It is not until the old man awakens each day that the struggle within him is apparent. This may be the reason why the narrator is so obsessed with watching the old man sleep. The actual act of murder, which the man believes was premeditated, was in fact a spur of the moment action. He toiled with the idea while the man was awake, that is, while he could see the evil eye. However, while the eye was closed, the man was at peace. One night, during one of the mans stalking sessions, the old man awakens. The man goes into a paranoid frenzy, mistaking the beating of his heart for the beating of the old mans heart. During this frenzy, the man is afraid that neighbors will hear the beating of the old mans heart. This causes the man to take action. He quickly subdues the old man and kills him. He then takes extreme steps in disposing of the body, dismembering it and burying it under the planks in the floorboard. These extreme actions can be used as evidence to the paranoia that is taking o ver him. The fear of getting caught would be a normal reaction to someone who has committed a murder. Actual v/s Expected figures Qualitative vs. quantitative The qualitative indicators help to understand the behaviour of the humans in accordance with the perspective of the informant. It also helps to assume a reality which is negotiated as well as dynamic. This is a very useful tool for a new organisation which is planning to operate their business successfully. It provides a conceptual method to the organisation as mentioned above. Similarly, it includes some methodological factors which an organisation should be concerned with. In this format firstly the data is collected according to the observation of the participant as well as their interviews. After that, it is the responsibility of the management of the organisation to analyse the collected data. The analysis is done with the help of the descriptions and the themes of the interview along with the organisations a whole. When all of these processes are done, it is the time for the reporting the data in the informant's language (Farmer and Xie, 2012). On the other hand, the quantitative indicator is another useful tool for the development of the organization which is planning, to begin with, their business plan. This type of indicator also helps the organization conceptually. It helps to discover the various facts regarding the social phenomena. Contrary to the qualitative indicator it assumes the reality on the basis of a measurable and fixed data. The process of the execution of this indicator also differs from the former indicator. For example, in this process, the data is collected through the measurements and statistics instead of the observation of the participants. After the collection of the data, it is the job of the management of the organization to analyze the data with the help of appropriate numerical comparisons and arithmetical inferences (Connecting with your customers, 2006). Last but not the least similar to the qualitative indicator, in this process also the data is reported but in a different manner, which is s tatistical analysis. Thus it is quite clear that both of the indicators are equally important for an organization and they have their own value to the business of the organization. Possible Qualitative and Quantitative Indicators for Booth's Engineering Company Booth's engineering company has concerned the human resource behavior understanding the informant's perspective; it has also assumed a negotiated and dynamic fact in the real world. The data are collected through the observation and interview. The company has also remembered the fact of the language of the informant (Armstrong and Armstrong, 2011). These are the qualitative indicators whereas this company has concerned the social phenomena in the field of discovering new facts. The reality is fixed and measurable which has helped the company on many issues. By measuring different things data are collected and these data are reported through statistical analysis. Theories of Creativity Essay Example

Theories of Creativity Paper Theories of Creativity and Quality Theories of Creativity and Quality Theories of creativity are vast. Several psychological theories on the process of creativity are chronicled. Some theorists explain creativity as intrinsic creative motivations, which individuals create a project for the sake of creating (Wibell, 2011). Other theorists convey the brain controls levels of creativity, and mental illness has an impact on creative process. Further, many believe the humanistic theory of creativity spawns the creative process. Through self-actualization creativity comes in peak experiences. The quality of the work depends on what is measured. The quality of the creative work depicts the message of the writing. The message can be entertaining, or educational. The humanistic theory of creativity stems from self-actualization described by Abraham Maslow, a pioneer in humanistic psychology. Maslow believes that creativity is divided into three categories; primary creativity, secondary creativity, and integrated creativity. This theory encompasses the gestalt of human intelligence and emotional state as well as the needs that must be met in order for someone to be completely able to express his, or her creativity. Primary creativity according to Maslow, allows self to escape from life stress. Individuals channel life stresses into creative art such as painting, sculpture, or writing. Secondary creativity results from the use of higher thought powers. Secondary creativity takes over from primary creativity and adds to it through the preparation stages (Bergquist, 2011). Integrated creativity stems from combining primary and secondary creativity that results in great works in art, philosophy, and scientific discoveries. The creative integration is also characteristic of self-actualized emotionally healthy individuals. In order for the individual to reach the self-actualization level a series of hierarchy achievements must be accomplished; creativity can flourish only after the levels described have been reached. For example, the need for safety can come in various forms such as a safe place to live. Creativity may be hard to accomplish if an individual is homeless with the exceptions of J. K Rowlings the author of the Harry Potter series, and Tyler Perry, playwright; both homeless, living in cars when writing mega-hit products. The mental illness theory allows the writer to access the parts of the brain that generates abnormal ideas, which can differ from the norm as they may be considered strange. Not everyone who is considered creative is stark-raving mad, however; there are certain elements that tend to be present in highly creative people who cause them to view the world differently and choose to portray it in a different light. Additionally, people whose thought processes differ from the majority have a tendency to want to escape from reality and may choose to do so through the creative arts. The extent of level of mental illness is not necessarily relevant to an individual’s creative ability. In individuals such as Vincent Van Gogh—where it was believed he suffered from mental illness—the level of this illness was not fully determined or relevant, yet his creative works remain very much alive in the world today. The mental illness theory suggests that individuals intensely creative—and whose creative ideas are viewed as strange—are believed to suffer from mental illness that also diminishes their ability to fully function in society. This theory offers the possibility that an abnormality is present in some people to cause the desire to explore a darker side of their psyche. Any difference in a persons thought process that differs from the norm can be considered a mental illness in some way, or can be linked to one; this difference is not necessarily a negative thing because if this abnormality is mild, and it will rarely interfere with an individuals’ ability to operate in society. Carl Jung (1953) extends creative functioning by further dividing artistic creativity into two categories, psychological art, and visionary art. Art is considered psychological art and appears to be generated by primary processes. With this Maslow’s humanistic theory of creativity ties into with his theory about needs requiring to be met before reaching a higher point of creativity. Visionary art which derives its existence from the hinterlands of the mans mind, is the type of art where the strange worlds and ideasdescribed by the mental illness theory of creativityare generated from, as it connects creative individuals with the super-human and timeless worlds beyond their conscious knowing. A plausible explanation for the relation of both the humanistic and mental illness theories similarities is attributed to author, Koestler who fails to represent any particular school of thought, but has had much success in creativity research. His premise on creativity is â€Å"bisociation† a term â€Å"coined by Koestler meaning to join unrelated, often conflictual, information in a new way. † He also goes on to say that this is similar to being double minded or able to think on more than one plane of thought simultaneously, and Frank Barron (1988) places the possibility that developing the ability to â€Å"tolerate chaos or seemingly opposite information is characteristic of creative individuals† (Bergquist, 2009). In short, appears both theories may very well be related, but worded differently. The attributes discussed by the mental illness theory touches on the humans’ ability to think on two distinct planes. The humanistic theory also holds truth when discussing the various needs one must attain before clearly being free to explore creativity as the whole. Concerning creativity, everyone has an opinion as how to approach it and judge its core. Some believe that for a work to be considered creative it must meet a few specific requirements such as being of fantasy or science fiction. Others believe that in order for creative works—whether they are art or music based—to be considered creative they have to be based on imagination; however, Al Gore’s book, paper, and PowerPoint presentation on global warming was quite creative even though it only appeared to be in functional writing format. Analyzing Theories Two types of writing, creative, and functional writing are of focus. Functional writing encompasses writings such as those found in phone manuals, data analysis, and essays; whereas creative writing has often been judged upon the inventiveness of the topic, for example, a fable or parable, a fiction story, or poetry. However, it has been determined by this team that the creativity writing and its quality should be judged on the content as well as the message it delivers to its intended audience. According to Mark Barrett, a writer and opinionated individual, writing should be judged according to the basis for writing. For example, if a writer writes to entertain or inform, the writing should be judged on whether or not it is powerful and clear or muddy and confusing. If writers write for the simple pleasure of writing or to have others enjoy their work, then the content should be judged on whether or not it is enjoyable (Barrett, 2010). Furthermore, there exist various methods of judging writing are based on what the judge considers to be correct according to the extent of their personal experience. However, most writers have agreed that the fundamental rule for judging lies in assessing the total impact of the passage, i. e. the combination of the creative ingenuity and the use of language (Chedzoy, n. d. ). The quality of a specific work should be evaluated for message and interest; in other words is the writing based on the interests of the writer. The creative work should be judged on the value, lesson, or educational message it conveys and the impact this has on the audience. Additionally, the flow and technical aspect of the writing should also be judged because the creative piece should flow naturally without fault or hindrance of grammatical errors and should emphasize pauses for thought, commas, or periods, (Hoosierpoet, 2004). As judges, questions regarding the writer’s choice in language or words must always be examined because these have an effect on the works’ purpose. Originality is key to being a great writer; it is important to use personal thoughts, ideas, and words when creating a work and if inspired by another’s work, it must be so noted. Finally, the judging of any work is complete when elements of the work are brought together and an impact has been made. Applied Theories Abraham Malsow’s humanistic theory of creativity specifies creativity occurs in stages. According to Maslow levels of achievement must be accomplished in order for creativity to flourish. Self-actualization is the goal of humanistic theory, and self-actualization occurs in stages. Once the stages are accomplished the individual has peak experiences, and peak experiences allow creativity to flourish. As a self-actualized creator there is an inclination to spark creativity across a vast number of areas. Through writing self-actualized creative writers can express ideas and impulses without fear of criticism, and thus are better able to produce, or express creative ideas, (Cassandro Simonton, 2011. ) Humanistic theory of the process of creativity for writing occurs in stages. In fiction writing hierarchy levels of achievement were required. First physiological needs met, the need for creative space. Creative space is anywhere from a room of one’s own to write in, to a small desk, in a shared room. Depending on the creative project the space may require isolation. Next is the need for creative peers such as classmates, or others in the same area of creativity to provide feedback. A need to surround self around others to obtain insight, information, ideas, or encouragement is essential (Morris, 2009. The need for creative inspiration follows. Inspiration can come in a variety of methods. For example, books, magazines, life experiences, the outside environment, and people watching inspire many creative writing processes. Another level on the hierarchy pyramid is imaginative space to doodle, scribble, or journal writing, which is different from physiological space, and allows creative energies to flow. The ability to have the freedom to expose the crea tive edge in the creative writing process assists in meeting the hierarchy levels of achievement. Solving problems, pushing boundaries, or developing something new is the heart of the creative writing process (Morris, 2009. ) When writing something from nothing more than a thought the writer needs to have faith in what he, or she is writing and believe in the final writing project. Additionally creative writing seeks an audience. In writing fiction the writer normally looks forward to his, or her work receiving feedback from peers, and enthusiastic responses from friends, and family. The need for certainty in an uncertain market is required. Creative writing, or creative arts of any sort require certainty in other areas such as home, relationships, or income assist in financially sustaining the writer throughout the creative writing process as he, or she work on the craft. Last on the humanistic theory of creativity hierarchy level of achievement is the need for time to cultivate the art of writing. Writers have to make choices in daily activities that allow for creative writing time to unfold. This means telling others no to activities, or completing chores early to allow time to write. Hierarchy levels of achievement are individualistic as pertains to the humanistic theory of creativity. Reference: V. Cassandro, and D. Simonton, (2011) Creativity and Genius. How to Get an Online Teaching Position

How to Get an Online Teaching Position Teaching online can be very different from teaching in a traditional classroom. An instructor who accepts employment teaching online must be prepared to help students learn without face-to-face interaction and live discussion. Teaching online isn’t for everyone, but many instructors enjoy the freedom of virtual instruction and the opportunity to interact with students from around the nation. To find out if teaching online might be for you, explore the pros and cons of e-instruction, as well as the requirements necessary for becoming a virtual instructor and the ways you can find a job that allows you to reach and teach students right at your computer. Qualifying for Positions In order to qualify for a position teaching online, applicants must generally meet the same requirements as traditional teachers. At the high school level, online teachers must have a bachelor’s degree and a teaching license. At the community college  level, a master’s degree is the minimum requirement for teaching online. At the university level, a doctorate or other terminal degree is generally required. In some cases, colleges accept adjunct online professors without requiring them to meet the same standards as traditional, tenure-track teachers. (Teacher tenure, sometimes referred to as career status, provides job security for  teachers  who have successfully completed a probationary period.) Working professionals may also be able to land an online teaching position in relation to their chosen field. At every level of teaching online, schools seek candidates who are familiar with the internet and content management systems such as Blackboard. Prior experience with teaching online and instructional design are highly desirable. Pros and Cons Teaching online has many advantages. Virtual instructors are often able to work from anywhere they choose. You could get a job teaching online for a prestigious school in another state and not have to worry about relocating. Since many e-courses are taught asynchronously, instructors are often able to set their own hours. Additionally, instructors who make a living at online instruction are able to interact with pupils from around the nation. Teaching Nomad notes that teaching online offers a great availability of jobs, flexibility, simplicity and a close, personal connection to students. That last advantage may seem counterintuitive, but large class sizes at brick-and-mortar schools often can prevent instructors from getting to know all of their students. Online, however, since your hours and time are flexible, you can reach out to each of your students individually, get to know them and provide one-on-one help as needed. Using a computer also negates the need to print out hundreds of tests, quizzes and even syllabi and course outlines since all material is presented online. Teaching online, however, also comes with some drawbacks. Online instructors must sometimes teach a prepared curriculum, denying them the ability to use materials that have proved successful in past courses. Teaching online can be isolating, and many instructors prefer interacting face-to-face with their pupils and peers. Some schools do not value online adjunct teachers, which can result in less pay and less respect in the academic community. Best Places to Look Some colleges fill online teaching positions by selecting from the current faculty pool. Others post job descriptions specifically for instructors interested in teaching online. Not surprisingly, youll find most online teaching jobs where youd expect: online. For example, GetEducated, a free online counseling center for adult students as well as educators, offers seven websites that list multiple online teaching positions. When looking for positions on websites without a distance learning focus, simply type â€Å"online instructor,† â€Å"online teacher,† â€Å"online adjunct† or â€Å"distance learning† into the search box.

Cloture Defintion - Senate Rule to Break a Filibuster

Cloture Defintion - Senate Rule to Break a Filibuster Cloture is a procedure used occasionally in the U.S. Senate to break a filibuster. Cloture, or Rule 22, is the only formal procedure in Senate parliamentary rules, in fact, that can force an end to the stalling tactic. It allows the Senate to limit consideration of a pending matter to 30 additional hours of debate. Cloture History The Senate first adopted the cloture rule in 1917 after President Woodrow Wilson called for the implementation of a procedure to end debate on any given matter. The first cloture rule allowed for such a move with the support of a two-thirds majority in the upper chamber of Congress. Cloture was first used two years later, in 1919, when the Senate was debating the Treaty of Versailles, the peace agreement between Germany and the Allied Powers that officially ended World War I. Lawmakers successfully invoked cloture to end a lengthy filibuster on the matter. Perhaps the most well known use of cloture came when the Senate invoked the rule after a 57-day filibuster against the Civil Rights Act of 1964. Southern lawmakers stalled debate over the measure, which included a ban on lynching, until the Senate mustered enough votes for cloture. Reasons for Cloture Rule The cloture rule was adopted at a time when deliberations in the Senate had ground to a halt, frustrating President Wilson during a time of war. At the end of the session in 1917, lawmakers filibustered for 23 days against Wilsons proposal to arm merchant ships, according to the Senate Historians office. The delay tactic also hampered efforts to pass other important legislation. President Calls for Cloture Wilson railed against the Senate, calling it the only legislative body in the world which cannot act when its majority is ready for action. A little group of willful men, representing no opinion but their own, have rendered the great government of the United States helpless and contemptible. As a result, the Senate wrote and passed the original cloture rule on March 8, 1917. In addition to ending filibusters, the new rule allowed each senator an additional hour to speak after invoking cloture and before voting on a bills final passage. Despite Wilsons influence in instituting the rule, cloture was invoked only five times over the course of the following four and a half decades. Cloture Impact Invoking cloture guarantees that a Senate vote on the bill or amendment being debated will eventually happen. The House does not have a similar measure. When cloture is invoked, senators are also required to engage in debate that is germane to the legislation being discussed. The rule contains a clause the any speech following the invocation of cloture must be on the measure, motion, or other matter pending before the Senate. The cloture rule thereby prevents lawmakers from merely stalling for another hour by, say, reciting the Declaration of Independence or reading names from a phone book. Cloture Majority The majority needed to invoke cloture in the Senate remained two-thirds, or 67 votes, of the 100-member body from the rules adoption in 1917 until 1975, when the number of votes needed was reduced to just 60. To being the cloture process, at least 16 members of the Senate must sign a cloture motion or petition that states: We, the undersigned Senators, in accordance with the provisions of Rule XXII of the Standing Rules of the Senate, hereby move to bring to a close the debate upon (the matter in question). Cloture Frequency Cloture was rarely invoked in the early 1900s and mid-1900s. The rule was used only four times, in fact, between 1917 and 1960. Cloture became more common only in the late 1970s, according to records kept by the Senate. The procedure was used a record 187 times in the 113th Congress, which met in 2013 and 2014 during President Barack Obamas second term in the White House.

Commercial law ( commercial contracts ) Essay Example | Topics and Well Written Essays - 1500 words

Commercial law ( commercial contracts ) - Essay Example A contract is said to be formed only if such counter-offer is accepted. The common practice is that until acceptance is conveyed to the offeror, it is not valid. Some exceptions in this regard are a) if the offeror has waived the requisite for communication b) when acceptance is communicated by post, it will be effective on posting. Communication sent through fax, telephone, computer, telex or fax is not effective until received by the offeror. Moreover, it is arduous to find when exactly a telex, fax, a message left on a telephone answering machine or e-mail message is actually â€Å"received.† Decided case laws on the subject indicate that the time when such a message becomes effective relies on a number of issues including customary business practices, the anticipations of the contracting parties and the court’s evaluation of which of them should bear the onus as decided in Brinkbon Ltd v Stahag Stad Gmbh1. In case of acceptance through the e-mail, the time when it will be effective has not yet been considered by the courts. It has been recommended that in case of e-mail acceptance, the postal rule can be applied as an intermediate is involved. Conversely, it is argued that general rule will be applicable, since e-mail messages are delivered instantaneous and there is no facility to find out when the e-mail message is actually delivered. Any uncertainty provisions in the commercial contracts may make the contract non -binding. For instance, an agreement that a contract is to have a ‘regular force majeure stipulations ‘is not binding as the same is uncertain, since there are no ‘customary force majeure stipulations ‘as decided in the case â€Å"British Electrical and Associated Industries (Cardiff) Ltd v Patley Processing Ltd2. â€Å" In â€Å"G Scammell and Nephew Ltd v Ouston3, â€Å"it was viewed that an arrangement or
